David Nitek

David is a disputes Partner in our Construction, Engineering and Infrastructure team. With extensive experience of litigation, arbitration, adjudication and alternative forms of dispute resolution. In addition to advising clients on formal disputes, David helps clients to establish robust processes for resolving claims without the need for legal proceedings.

David’s clients include contractors, subcontractors and consultants operating across a variety of sectors, with a notable emphasis on major infrastructure projects, both in the UK and internationally. David’s work often has a focus on the Middle East, where he was previously based for several years.

David is listed in Who’s Who Legal as a thought leader for Construction. He is also ranked as a Recommended Lawyer in The Legal 500 for both Construction: Contentious and Rail, and in Chambers UK for both Construction: Contentious and Construction: International Arbitration. He is praised for his “ability to look into the future and pre-empt what might happen in a dispute.”

David has co-authored the chapter on Construction Arbitration and Turnkey Projects in the GAR Guide to Construction Arbitration.

Notable cases:

• Advising a contracting joint venture on a series of arbitration proceedings arising out of a major rail project in Asia, including final account claims commenced by a designer and two civil works contractors.

• Advising a member of a contracting consortium on arbitration proceedings following the termination of an EPC contract for a major European rail project.

• Advising a public sector employer on the defence, in adjudication proceedings, of an extension of time claim of over 400 days. The dispute arose under a design and build contract for a major rail project.

• Advising an employer on three parallel adjudication proceedings arising out of a major power project in Europe, including the defence of claims for a 450 day extension of time following significant time and cost overruns.
